Terms and Conditions

• 1. Information on how to enter forms part of the terms and conditions of entry. Entry into the promotion is considered acceptance of these terms and conditions.
• 2. Entry is open to Australian residents 18 years and over of NSW, VIC, QLD, SA, NT, TAS and WA who purchase a Subscription to Australian 4WD Action between 20th February, 2014 and 20th March, 2014 with the last mail received (inclusive).
• 3. Officers, employees, successors or assigns of the Promoter, the “Promoter” being Express Media Group, A division of Express Publications Pty Limited, 2 Stanley Street, Silverwater NSW 2128, ABN: 96 057 807 904, and Express Media Group, A division of Express Publications Pty Limited (the “Supplier”), located at Level 2 Stanley Street, Silverwater NSW 2128; and their parent companies, agencies in the promotion, as well as immediate family of any of them are ineligible to enter.
• 4. Eligible entrants are permitted only one entry per valid email address. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry.
• 5. The competition commences on Thursday 20th February, 2014 and closes on Thursday 20th March, 2014 with the last mail received. ('Promotion Period').
• 6. How to enter - Entrants must purchase a Subscription to Australian 4WD Action between 20th February, 2014 and Thursday 20th March, 2014 (inclusive). Entrants must go to www.magstore.com.au/4wdtrip14 and complete the Subscription Registration / Order Form. Once submitted, ensuring the order is signed against a nominated valid credit card or if paid by money order is cleared for payment, all orders will automatically go into the draw for a chance to win.
• 7. No responsibility will be taken by the Promoter for any ineligible or lost entries or entries submitted or received by the Promoter after the closing date. Entries that do not comply with these terms and conditions, are incomplete, or submitted or received by the Promoter after the closing date will be declared void.
• 8. The overall competition prize draws will be conducted at four different intervals. First prize draw will take place at 4:00PM EST Friday 28th February, 2014 , the second at 4:00PM EST Friday 7th March, 2014 , the third at 4:00PM EST Friday 14th March, 2014 , and the fourth at 4:00PM EST Friday 21st March, 2014. All competition prize draws will be conducted at Express Publications Pty Ltd, 2 Stanley Street, Silverwater NSW 2128. The winners will be contacted by phone OR email relying on contact details provided by the entrant. The result of the prize draws are final and no correspondence will be entered into.
• 9. All winners’ details will be published on www.4wdaction.com.au and www.facebook.com/4wdaction
• 10. The winners will win the prize of a weekend 4wd trip away with Graham and / or Shaun. Prize includes accommodation, food and beverages only and excludes flights, transfers, spending money or any other costs associated with the prize.
• 11. Total prize value is worth approximately $10,000. Prize is not transferable or exchangeable or redeemable for cash or any other goods. The Promoter accepts no responsibility for any variation in the value or available of the prize.
• 12. If any winners are under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian.
• 13. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element will be forfeited.
• 14. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
• 15. If any prizes remain unclaimed after 3 months from the draw dates, a redraw will be done at 4:00PM EST on 1st June, 2014 at Express Publications Pty Ltd, 2 Stanley Street, Silverwater NSW 2128. The winner/s will be contacted by phone OR email relying on contact details provided by the entrant. The winner/s details will be published on www.4wdaction.com.au and www.facebook.com/4wdaction
• 16. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
• 17. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
• 18. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
• 19. As a condition of accepting a prize, winners may be required to sign legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
